Step-by-Step POA Attestation Process in the UAE
For a UAE-issued Power of Attorney intended for use abroad, the process starts with UAE notarisation, followed by UAE MOFA attestation, destination-country embassy legalisation and, where required, final attestation in the country where the POA will be used.
Prepare the Power of Attorney: The POA must clearly state the principal, appointed agent or attorney, exact powers being granted, geographical scope and validity period. Banking, company, property, certificate retrieval or legal representation powers should be written specifically in the document.
Notarise the POA in the UAE: The Power of Attorney is notarised through the relevant UAE court or notary. A Dubai Courts POA can be issued electronically with QR verification and digital authentication, without requiring an additional physical notary stamp or signature.
Complete UAE MOFA Attestation: After notarisation, the POA is submitted for UAE Ministry of Foreign Affairs attestation. The attestation category depends on the purpose of the document. A personal POA is attested under the personal-document category at AED 150, while a commercial or banking POA is processed under the commercial-document category at AED 2,000. UAE MOFA attestation can be issued digitally on the authenticated document.
Complete Destination-Country Embassy Attestation: The MOFA-attested POA is then legalised by the embassy or consulate of the country where it will be used. For example, a UAE-issued commercial Power of Attorney for use in Oman can be attested by the Embassy of the Sultanate of Oman in Abu Dhabi after completion of the UAE requirements.
Complete Foreign Ministry Attestation in the Destination Country: If the destination country requires final local authentication, the POA must then be submitted to its Ministry of Foreign Affairs. How long is a POA valid for in Dubai?
The validity of a Power of Attorney in Dubai is determined by the validity period written in the POA itself. A POA can be issued for a specific transaction or for a defined period. - Real estate agents: DLD no longer allows anyone working for a real estate company to act as POA holder for property sale or purchase, regardless of their designation.
- Original title deed: When a POA is used to sell a property, DLD takes the original POA document on the day of sale.
- Off-plan property: For off-plan sales or transfers, check with the developer and RERA for any additional POA requirements specific to the project.
