Foreign Power of Attorney Attestation for UAE Use

A power of attorney signed outside the UAE has no legal standing in the country until it completes the full attestation chain. Dubai Courts, Abu Dhabi Courts (ADJD), banks, the Dubai Land Department, free zones, and all UAE government authorities require the POA to carry UAE MOFA digital attestation with QR code before they will accept it.

Attestation Chain

Step 1: Sign the POA before a notary public in the country where you are located. You must appear in person. The notary verifies your identity and witnesses the signing.
Step 2: Get the notarized POA legalized by the foreign affairs ministry of that country. For Hague Convention members, this is an apostille. For non-Hague countries, full MFA legalization is required.
Step 3: Submit to the UAE Embassy or Consulate in the country of issuance for embassy legalization.
Step 4: UAE MOFA digital attestation in the UAE with QR code verification.
Step 5: Arabic legal translation by an MOJ certified translator, stamped by the Ministry of Justice.

Creating a Power of Attorney Inside the UAE

If you are physically in the UAE and need to create a POA, you have four options:

MOJ Digital POA (E-Notary)

The UAE Ministry of Justice launched a digital POA system at moj.gov.ae. Eight POA types are available online: lawyer representation, real estate, rental disputes, licensing, vehicles, stocks, company management, and legal cases. You log in with UAE PASS, fill the form, and the POA is digitally notarized with a blockchain verified QR code in under 10 minutes. No need to visit a notary office. Available in Arabic and English. The digital POA is stored in a digital wallet and can be shared with authorities electronically.

Dubai Courts Notary Public

For POAs related to Dubai based transactions, the principal appears in person at Dubai Courts with valid identification (passport or Emirates ID). The POA must be in Arabic or bilingual. After notarization, two originals are provided. Dubai Courts also offer e-notarization via video call for principals who cannot attend in person, provided they have a valid passport.

ADJD Notary Public (Abu Dhabi)

The Abu Dhabi Judicial Department provides notary services for all POA types including general, special, company, vehicle specific, and signature authorization. ADJD operates an English Language Notary Services Bureau that handles English language documents directly, saving translation time and costs. Power of Attorney for Property Transactions in Dubai

  • Selling: The POA must be a special POA that names the specific property as per the title deed. A general POA is no longer accepted by DLD for property sales. The POA is valid for 2 years for selling.
  • Buying: A general property POA is accepted and allows the agent to purchase more than one property. The POA is valid for 5 years for purchasing.
  • Sale funds: DLD requires that sale proceeds are paid by manager’s cheque only in the name of the owner as stated on the title deed. The POA holder cannot receive funds in their own name.
  • Real estate agents: DLD no longer allows anyone working for a real estate company to act as POA holder for property sale or purchase, regardless of their designation.
  • Original title deed: When a POA is used to sell a property, DLD takes the original POA document on the day of sale.
  • Off-plan property: For off-plan sales or transfers, check with the developer and RERA for any additional POA requirements specific to the project.
